Broken bones. Torn ligaments. Dislocated joints. These injuries are painful enough, but when doctors fail to spot fractures, botch orthopaedic surgery, or mismanage recovery, the consequences can be life-changing.
At Marley Solicitors, we help clients claim compensation when poor orthopaedic care makes injuries worse, not better. If you’ve suffered because of a misdiagnosed fracture, a failed joint replacement, or surgical errors, we’ll fight for justice and the payout you deserve.
What is orthopaedic negligence?
Orthopaedic negligence occurs when medical professionals provide substandard care in diagnosing, treating, or managing injuries related to your bones, joints, ligaments, or muscles.
You may be a victim of orthopaedic negligence if:
- A fracture was missed on an X-ray or scan
- Surgery was performed incorrectly or on the wrong site
- A joint replacement failed due to poor technique
- Recovery was delayed by poor post-op care or infection
- You were discharged too early, with an undiagnosed injury
- Nerve or tissue damage occurred during surgery
Common types of orthopaedic claims we handle
- Missed fractures (ankle, wrist, hip, spinal, etc.)
- Negligent joint replacements (hip, knee, shoulder)
- Surgical errors: Misalignment, incorrect screws/rods, failure to fix fractures
- Delayed diagnosis of ligament or tendon tears (ACL, rotator cuff, Achilles)
- Improper casting or splinting causing long-term damage
- Infection or complications due to poor hygiene or aftercare
- Nerve injury during orthopaedic procedures
These aren’t minor oversights. When orthopaedic care goes wrong, it can lead to permanent disability, chronic pain, and reduced mobility.
Do you have a claim?
You might, if:
- Your fracture or joint injury was misdiagnosed or ignored
- Surgery left you worse off than before
- You had to undergo additional or corrective procedures
- Your mobility or quality of life has been permanently affected
- You’ve lost time, earnings, or independence due to poor treatment
If any of this sounds familiar, speak to us. We’ll assess your case quickly and tell you, bluntly, if you have grounds to claim.
What can you claim for?
Orthopaedic negligence often leads to long-term issues. That’s why compensation can cover:
- Pain and suffering (past and future)
- Cost of corrective surgery or rehabilitation
- Loss of mobility or function
- Loss of earnings or future career potential
- Cost of care, equipment, or home adaptations
- Travel and medical expenses
- Psychological impact (anxiety, depression, PTSD)
We don’t settle for lowball offers. We calculate what you really need, then go after it.

Time limits – Act before it’s too late
You have 3 years from the date of the negligence, or the date you realised poor treatment caused you harm.
For children, the clock starts when they turn 18. For adults without mental capacity, time limits may not apply.
Either way, sooner is better. Evidence fades, memories blur, and insurers love delays.
