What Types of Claims Can You Bring to an Employment Tribunal?

Before initiating any discussions with your employer or pursuing an employment tribunal claim, it’s essential to understand the types of claims you may be eligible to make.

Employees have the right to bring a wide range of claims against their employers, covering various aspects of workplace treatment. While some claims are less common, they may still be relevant to your situation.

How Do You Determine Which Claims to Make?

The key to selecting the right claims for an employment tribunal is ensuring you have strong and credible evidence to support them.

Evidence can come in different forms, including written documents, digital communications (such as emails, SMS, or WhatsApp messages), and witness testimonies. (For more details, see our guides on gathering evidence and preparing witness statements.)

Below is list of common claims you can bring before an employment tribunal in England and Wales. You may choose to pursue one or multiple claims, depending on the evidence available. Claims can also serve as leverage in settlement negotiations with your employer.

Types of Employment Tribunal Claims

Employment tribunals handle a broad range of disputes. It’s important to seek legal advice before deciding which claims to pursue to ensure you follow the correct process.

Time Limits for Employment Tribunal Claims

Most employment tribunal claims must be made within three months (less one day) from the date of the issue. The exception to this rule is redundancy payment claims, which have a longer timeframe.

If you miss the deadline, you may lose the right to bring a claim and could also lose leverage in any settlement negotiations with your employer.
